COST OF SERVICES
Unless clearly specified by us in writing as a firm quote, any fee / freight rate mentioned is an estimate only.
McCullough Ltd reserves the right to pass on any costs incurred for additional services required, due to unforseen circumstances relating to a shipment.
For example: towage, crane hire, exchange rate etc…
Every effort will be made to keep you, the customer informed of any variations.
TERMS OF PAYMENT
Our preferred method of payment is by direct credit to our bank account as advised by us to you. If you choose to make payment by credit card, we reserve the right to pass on to you any costs incurred by us in accepting such payments.
Unless otherwise stipulated by our credit controller in writing, payment of the cost is due immediately upon invoice being issued by us.
In the case of delinquent accounts we reserve the right to charge interest on any monies which are overdue, commencing on the due date until the day of actual payment. The interest rate will be the then current overdraft interest rate charged by our bank plus 9% per day.
All payments by you must be made in full and without any deduction or right of set off or counterclaim.
Unless otherwise stated, all prices exclude GST and other taxes and duties which, if payable, are payable by you.
If you do not pay the invoices specified therein within 14 days of the date of the reminder notice, you agree to:
- the debt passing to a debt collection agency to enforce payment of the money owing by you and the cost of the said debt collection which incurs a 25% commision on top of the monies owing to us;
- any solicitor/client costs incurred by us in enforcing payment of the money owing by you.
DELIVERY
If we believe that you may not make any payment when due, then we may suspend or cancel delivery.
McCullough Ltd reserves the right to withhold delivery of goods or any official documentation (De-Registration Certificates / Log Cards) until all requirements / overdue accounts of McCullough Ltd are met. Any further costs incurred will be charged to the customer, unless otherwise specified.
McCullough Ltd reserves the right to place securities over vehicles or commodities if there is an outstanding debt to McCullough Ltd or a Supplier. An outstanding debt may cause goods to be held in a secure storage facility with all costs associated for the account of the importer / exporter e.g transport, storage, administration. McCullough Ltd also reserve the right to dispose of the goods in order to recoupe the outstanding debt.
When agreed, goods shall be delivered to the customer or designated address. The company will use all reasonable endeavours to ensure delivery occurs at the specified time, or make goods available for collection as agreed, but should delivery be delayed for any reason, McCullough Ltd will not be responsible for any loss or damage sustained by the customer or any other person, firm or corporation by reason of such delay.
Immediately upon delivery the goods must be inspected by you and if any of the goods are damaged, we must be advised by you within 24 hours so that the claim for damaged goods can be made against the carrier. We will accept no liability of loss or damaged goods.
